notation on rental check

on rental check payment. the month of check was change to the previous month, the month was totally incorret and had been paid. notation of the month was written on top of the correct month. is this in violation of lease agreement, can an person be released from agreement. owner of check did not put notation on check.was not contacted.

The landlord should not be altering checks in any way which have submitted by the tenant for the payment of rent. If such alteration has been deliberately done and has resulted in the tenant being charged twice for the same month, this could be a material violation of the lease, which if not timely corrected by the landlord, might be a basis for finding the landlord in

a breach of the lease materially sufficient to warrant declaring the lease null and void.
