Legal Question in Landlord & Tenant Law in Virginia

pitbull

Can the Property Manager of an apartment comlex tell you to get rid of your dog? Based on the breed? Even though there was nothing on the lease agreement about breed restrictions.

Re: pitbull

Assuming that domestic animals are normally permitted at your apartment complex, if there's any provision in your lease agreement which addresses the issue of possible harm or danger to residents or guests caused by any animals(irrespective of breed) harbored by residents or guests of the apartment complex, or even any very generally worded terms in the lease empowering the manager of the complex to take whatever action may be deemed necessary to protect the aforementioned residents or guests from harm, the answer to your question must necessarily be, yes, if your dog is a Pitbull, Rotweiler, or other breed of animal that has a demonstrated track record of attacking human beings, the property manger, under the terms of this kind of provision in your lease, would have(in my opinion) apparent authority to order you to remove the animal permanently from the premises.
