I rented my house to

My brother and two of his friends. They have been late on rent every month since they started renting from me. This past month they made partial payment on May14, but didn't pay anymore. I have sent texts and left phone messages every 3 days asking what is going on etc. I finally sent a late notice stating late 21 days. And sent another late notice on June 1st because they are now over 30 days on the 750.00 remaining balance.

But now it is June5th and they are late on Junes rent 1350.00 plus late fees.

Can I sent a five day pay or leave notice. Will this start eviction process.

Financially I'm in a bind and I'm upset because it is family but I'm not the only one that owns this house my fianc�e does too. And they are not happy.

We feel we are being taken as stage of.... And not sure how to handle this legally.

Yes, serve them with the 5 DAY PAY OR QUIT notice and (unless everything then becomes all paid up within that timeframe) commence

eviction procedures in your local general district court(civil division) by

filing what's called a Warrant for Unlawful Detainer.
