Legal Question in Landlord & Tenant Law in Virginia
Roommate Agreement
I was recently forced out of my apartment by my former roommates. We had a roommate agreement that stated that if I chose to leave, I needed to give 30 days notice and was responsible for the full month's rent, until they found a new roommate. They told me on 8/13 to be out by 9/12, and told me I was to pay for the whole month of September. Rather than argue, I paid the whole month and was out by the specified date. When I moved in, I was required, by the roommates, not the apartment complex, to pay a $500 security deposit with the understanding that when I moved out, I'd get it all back. I have been out for almost a month now, and they refuse to give it back until they find a new roommate, claiming that was part of the roommate agreement. My understanding of the agreement was that this was only if I chose to leave, which I did not. What are my rights? Was I actually responsible for that extra 3 weeks of rent?

Re: Roommate Agreement
Small Claims Court would appear to be your remedy for this situation where you can hash matters out as to what the agreement included and get an enforceable ruling from the judge--all for less than $40.
