Legal Question in Landlord & Tenant Law in Virginia

Security Deposit

I live in Prince Williams County Va. I would like to know that if I accept payment from my landlord that is less than my security deposit and that we are in disagreement over, can I take him to the county Small Claims Courts and sue him for the remaining monies are more.

Re: Security Deposit

Yes, you can, but don't file a case if the landlord has some half-way credible reason for retaining the difference between what he refunded to you from your security deposit and what he retained ostensibly to repair or refurbish your unit after your tenancy ended.

You can make a reservation of rights below your endorsement on any refund check that you may receive from this landlord.
