Legal Question in Landlord & Tenant Law in Virginia

My son signed a lease in Jan for 1 yr with his girlfried. She has become abusive and we moved him home. He left with just his clothes. She is moving home as well. This is Sept. and they just paid the Oct. rent early. They put down 1200 deposit. Contract ends in Jan. I was reading over his agreement and occupancy guidelines say at least 1 adult has to be over 21 at time of signing contract. Both are 20. Is this a loop hole to get out of this contract. That would leave 3 months left to pay and if we forfeit deposit that pays Nov. and $300 on Dec. Rent is $900 a month. We took the police there so he could get out his belongings and notified Landlord. What are his options.

The provision which you've cited is not a requirement for such contracts under the Code of Virginia and if all parties properly signed the lease, it likely would be regarded as effectively waived and would not be considered as a ground to void the contract, thereby releasing the tenants from their respective obligations

under this lease.
