Legal Question in Landlord & Tenant Law in Virginia

Can I sue my previous landlord for the remaining amount of my deposit if he has foreclosed on the property and filed for bankruptcy? This is in Loudoun County, VA. He agreed to pay me in three installments, giving me three post-dated checks for $600 each. The first one cleared on November 1st, but as I'm about to cash the one for December 1st, he e-mails me today telling me he put a stop on it, along with the January check, because he's having "cash flow problems". What recourse do I have? I moved out at the end of the lease agreement and left the home in excellent condition.

If the landlord's referenced debt to you is included in his bankruptcy

estate, then you are likely without a remedy.

However, if such is not the case, then you're likely

free to sue him in small claims court for the $1200 +

your court costs.
