Legal Question in Landlord & Tenant Law in Virginia

Tenant won't move out

Our tenants lease is up. The lease does not automatically convert to a month to month. She is already two months in arrears. She is having difficulty finding a place to live so like a numskull I told her that she could stay until the middle of the month providing she paid 1/2 rent by last Friday. If she did not pay, she was to vacate the premises immediately. She did not pay and she has not left. She states she is trying to find places to live, but no luck yet. How can we get her out? How can we get our back rent? Thank you so much!

Re: Tenant won't move out

File an unlawful detainer action against this holdover tenant in your local general district

court with a request for a judgment against her for all rental arrearages owed and any other includable costs along with a writ of possession for the unit.
