Legal Question in Landlord & Tenant Law in Virginia

in VA, rented a townhouse with bf. He cheated and I paid my half of the rent for June and moved out the 28th. He moved one person in after that and she didn't work out so he moved his friend and a dog in. They damaged the home ( carpet, walls, etc. ) and he was eventually evicted for not paying. The Housing management contacted us to pay for the damage to home and unpaid rent and had us both seperatly sign a contract to it back which totaled $5000 or they would put holds on our accounts, banks, wages, etc. I paid the entire $5000 ( yes I have receipts, bank statements for everything paid and both of our separate agreements to pay) can I sue him for his half? I have all my documents in order and want to be sure before I have this filed in small claims court.

Absolutely. That is the correct approach. Assuming that you have a physical address for him. Also if you know who lived there after you, you should sue them as well because you don't know who damaged the home and they all may be responsible.

You can sue them for "contribution" on the lease between co-tenants (him) or subletters (the other people).

You want to fill out a Warrant in Debt form which you can get from the court or from the website at
