Legal Question in Landlord & Tenant Law in Virginia

in Virginia, can any part of a security deposit be deemed non refundable? everything I can find points to my previous experience in different states. deposits are refundable by being called a deposit. only fees spelled out in the lease can be kept by the landlord. my landlord is stating that half of my security deposit is non refundable per the lease. I am saying that paragraph is not in compliance with law.

Without reviewing your lease in conjunction with Va Code Sec. 55-225.19 A (Security deposits), the first

paragraph of which concludes as follows: "The security deposit and any deductions, damages, and charges shall

be itemized by the landlord in a written notice given to the tenant, together with any amount due the tenant, within

45 days after termination of the tenancy and delivery of possession: (of the rental unit), I couldn't offer

an opinion on this matter.
