someone else used my photo and used their byline - they did not take the photo, I did. It was used in local paper

Well, that is both a violation of your copyright rights as the taker of the photograph and your rights to "publicity" (your image), except that by allowing it to publish it in the local newspaper you may have weakened those rights somehow.
