Legal Question in Legal Malpractice in Virginia

A man at the age of 42 received a visectomy. After 17 months of constant sexual activity, she finds that she is pregnant. Can the Doctor be blamed for this? Because of this, the woman has to get an abortion as she can not afford another child and would become attached if she carried full term only too try adoption.

Many more relevant facts would be required to establish a viable claim against this particular doctor that what's been provided here in this question, beginning, perhaps, with credible proof that the woman's sexual partner during these 17 months has been limited to the "visectee" only and has not included another possible sperm donor.

Furthermore, even if such could be proven, I do not believe that many visectomies are performed these days with any guarantee that they will necessarily be 100% effective.
