Is this dentist error malpractice?

I had my second to last dentist replaced a filling behind one of my top front teeth in the back of it. This was not in the middle of the two large teeth, but on the backside of one next to the smaller one.

Needless to say he made an error and ended up giving me a gap between my two front teeth. I had perfect straight, no gap teeth prior to his work. He tried to ''fix it.'' There was no decay between my

front teeth. This can be proven with x-rays. He did not need to be there. I went back once more to this

dentist to fix his error and replace the filling he originally replaced

after his replacement fell out. After being disappointed with his work

yet again, I found a new dentist. After 3 more visits it looks ok, but

it's still no where near where it was. I am so self conscious about my smile now. What are my options legally? Can I file a small claims matter?

If, as you say, "it looks ok",(now), how would you calculate your real and credible monetary damages in this case which were proximately caused by a failure of the dentist to adhere to standards of dental treatment in replacing such fillings and which consequently fell below the standard of care prevailing in the community at the time such treatment was rendered?
