Legal Question in Medical Malpractice in Virginia

Gallbladder Runaround

My 22 year old son had been sent home on 3 different occassions from the ER in VA with gallbladder attacks. 1st time was told that ER had no ultrasound machine and he would have to go to family doctor. 2nd time sent home with pain med that made his heart beat too fast and he was afraid to take. 3rd time sent to check on free-clinic since he had no insurance. 2 wks. later had galbladder removed. 3 days later, severe no stop pain, returned to ER and told it was gas. By that night he was transported to another hospital for emergency surgery. Had a common bile duct leak and three large stones remained plus a severe bladder infection. Now pathology report says there is granuloma in the gallbladder. More test will be done once inflamation leaves, approx. 2 weeks. All this took place over a 16 month period. We feel that the Doctor who did the initial surgery was irritated that our son had no insurance and also that ER sent him home due to that fact. In this hospital, if they can get you out of the ER and send you to a physician, then before surgery you have to pay 100% up front before operation. The second doctor said that the gallbladder was one of few that he had seen in such severe condition. Case against Hospital # 1?

Re: Gallbladder Runaround

Without many more credible and relevant facts tending to prove that Hospital #1 failed to meet the standard of care then prevailing in that particular community at that time for the treatment of your son's gallbladder conditions/problems, I would surmise probably not.
