More relevant facts would appear necessary (in my opinion) to evaluate/determine whether your previous surgery did not meet the standard of care then prevailing in the community where it was performed, and, in particular, an opinion from an expert as to whether your current described medical condition has resulted from the previous surgeon's failure to meet that standard of care that should have been reasonably expected of him at that time.
