Legal Question in Medical Malpractice in Virginia
Misdiagnosed
I had a heart attack and stroke in March 2005. I was taken to two different hospitals in May, after having stroke symptoms. I was told that I was not having a stroke and was not treated, even though the left side of my body was not usable. I was even released from one hospital even though I could not sign my name. It was two days before I could see my neurologist and was then informed that indeed I had suffered a stroke and had I have been treated properly, I would not have suffered the loss of use of my left hand and speech impairment I have four witnesses that stayed with me the entire time I was in both ER Rooms. I am now unable to work and do not have any source of income. So I have a case against the hospitals?

Re: Misdiagnosed
The facts which you've outlined here would suggest that you may indeed have a valid cause of action against the hospital(s)which , apparently, failed to diagose properly your condition and which, consequently, then foreclosed the possibility of your being timely administered drugs which might well have mitigated the effects of the stroke.
The bottom line consideration: Did the treatment
which you received from these hospitals fall below the prevailing standard of care in the community for the particular condition with which you were afflicted at the time you were taken to the respective ERs of these hospitals?
The merits of your claim(s) will turn on the answer to this question.
Re: Misdiagnosed
If you can get at least one expert to state that the standard of care was breached by the hospital then you have a case. More medical info is needed to make this determination.
