Legal Question in Medical Malpractice in Virginia

Mother being over perscribed, what can I do?

My mother is taking more than seven medications a day. She has been seeing the same physiolgist for 4 plus years. During these years she's become dependent on zanex(sp?)and is now taking oxycontin. She is another person and I feel that is this doctors fault. She will need detox. She does not recognise her adiction and I want to help save my mother. Do I have a case legally?

Re: Mother being over perscribed, what can I do?

Unless you can prove by a preponderance of the evidence that the care which your mother received within the last four years from her physiologist for whatever malady she was being treated for, was below the prevailing standard of care in the community for this particular condition, you would not have a case worth taking to court.
