Legal Question in Medical Malpractice in Virginia

peritonitis developed after ''appendiceal stump leak''

I'm an 18 y/o female and I've been through a great deal of physical and mental pain these last few months. Long story short, I had an appendectomy in April... 13 days later I was rushed to the hospital in fear of my life. I was diagnosed with peritonitis. I went in for another surgery to clear the infection. I had to stay at the hospital for 6 days. (Fairfax Inova Hospital)

My second doctor(who didn't perform the appendectomy) in more words or less told me he didn't see any signs of ties/staples/stitches etc. on my large intestine. This is what resulted in infection.

I suffered breathing problems during my stay and lost 12 lbs. My pain level was 8-10 a majority of the time. I feel all of this could have been prevented considering my 2nd doctor said he had never seen this happen before.

I'm wondering if one surgery that is done incorrectly or with negligence, which then leads to infection, is considered medical malpractice. Please help, Thank you!

No one can tell from the information provided whether the surgeon committed malpractice. But, I can tell you that although I have no doubt that you suffered, if you are better now it is a case you should probably put behind you. Medical malpractice cases are expensive to pursue and difficult to win and unless there is a significant injury I do not recommend that you pursue it.
