Legal Question in Medical Malpractice in Virginia

Pharmacy malpractice/misfilled prescription

I recently had two prescriptions refilled at a local pharmacy, when I picked them up I was told one would appear different because they had switched manufacturers. When I got home I discovered one pill within my blood pressure medicine was different but so different I questioned it. I looked it up and found it was actually an antibiotic instead of my blood pressure medicine. I also found out that because of my known medical conditions it would be dangerous to my health should I take it. I understand that in Virginia I would have had to been injured to sue for damages but since I was not stupid enough to take the pill without question I'm wondering what if anything punitivly can I sue for.

No damages = no viable lawsuit in the Commonwealth = my estimate of your would be claim. (You could still, nevertheless, obviously raise hell with the local pharmacist over this improperly filled(and perhaps dangerous)prescription.)
