Legal Question in Medical Malpractice in Virginia
release of liability
We are being asked by a client to refund monies following treatment of his pet otherwise the client has stated he will seek 'legal action' in small claims court. Our practice has decided to pay this client but before we do so, would like him to sign a release stating that these monies being repaid are not an admission of guilt or wrong doing, that it is merely a form of business good will and that he has no present or future claims against us if he signs and accepts these monies.

sounds like a good idea, and reasonable. Without knowing the circumstances this is not an opinion on your potential liability, but it may be a good business decision. As for whether or not the release is properly drawen to protect you against further claims I dont know, but it cannot be used against you, as from the recital given it is obviously offered for settlement purposes.
