Legal Question in Medical Malpractice in Virginia
Had tubal liagation and infection trying to see what legal options are
I had a tubal liagation and the dr discharged me from hospital. Then a week later I ended up at the drs office with a staph infection that ate out a area of my stomach. Three months later she has stopped seeing me and I still have a hole in my stomach. I have severe pains in my sides and can not do things with my kids that I use to be able to do. I have been for years for trying to do all that I can when I asked her why it happened. She told me that the hospital must not of cleaned the area like they were suppose to do. I am trying to find out my legal rights and if there is anything that I can do. My life has been turned inside out because of this and I don't know what I should do.

If the hospital's practice standard of cleaning your surgical wound failed to at least meet the standard of care prevailing within the surrounding medical community at that time for cleaning up after such wounds, which your own physician appears to be confirming, you may well have a viable malpractice case against the hospital as well as the physician(s) responsible for this allegedly substandard care.
