Legal Question in Military Law in Virginia

Child Pornography.

Hello, my roommate found child pornography on my computer, and all my electronics were seized for investigation by NCIS. I was unaware the material was on there. I use a file sharing program that sometimes does not truthfully advertise the true nature of the files being downloaded. It has happened to me before, but i just said gross, and deleted it after opening it. I guess I didn’t notice these files; I sometimes download blocks of material at once, and then go to work, so it will be done by the time I get off work. What are the punishments for child porn in the military? I’m afraid that I will get convicted because I’m sure I have more ( not much more) bad material on there that I have deleted long ago when I noticed I had downloaded it. I’m just freaked out about felonies, jail time, and being a registered sex offender. Just don’t know how this works

Re: Child Pornography.

1. I do 7-8 military child pornography cases each year.

2. DO NOT make any similar statements on this website, it is public. You cannot guarantee that NCIS doesn't troll these sites looking for information.

3. Contact me ASAP for a free initial evaluation.

Re: Child Pornography.

The penlties for child porn in the military are very severe. In addition you may well be labeled a sex offender and have to register. This is very serious, but do NOT panic. NCIS has the computer and will search it for any evidence. There is nothing we can do about that now. DO NOT MAKE ANY STATEMENTS ABOUT THIS UNTIL YOU HAVE SPOKEN TO AN ATTORNEY!!!!!! Even though they may find pictures, you may have a defense if you did not know they were there. Do not make any statements or admissions to them. Do not talk to ANYONE without first speaking to an attorney. NCIS relies on tricking people into speaking and then using their statement against them.

Contact me if you have any questions or if I can be of further help.
