Desertion

My husband was in the Coast Guard and was approved for an

honorable discharge. He completed all physicals,checked out all his equipment,advised them what his plans where and even stated he was moving to Richmond to get married and even checked in to make sure everything was ok and was told it was. Everything was complete, so he thought. Well, on Thursday he was approached by USCG agents and arrested and taken to the Naval Brig and told he was being charged with desertion, even though the men told him he had been approved, he didn't finish the last paper? Obviously, a simple call would've prompted him to go in and finish, but instead he was treated terribly and has been taken from his family. Even the people there were shocked about it, and don't feel he needs to be in there, but he and I are so concerned and we haven't really been told anything about his rights or what we need to do. He goes in front of the magistrate Tuesday morning. Please help us.

There is a lot of information we will want to gather as soon as possible to determine what actually occurred here. One area which was not clear was when your husband left the Coast Guard. The one comfort you should have is that your husband should have been appointed a free military attorney to assist in this matter. It is important to get in contact with that attorney to have him/her explain the pretrial confinement hearing procedure to you which it sounds like he will be attending Tuesday.
