Legal Question in Military Law in Virginia
desertion
My son was injured last June and was not deployed with his unit. He has been reporting to his assignment at the naval base sense then. Today I received a letter from transient services saying he is a deserter and has been returned to naval custody and is awaiting discipline. He was never missing, I don't understand why this letter was issued.

Re: desertion
I am not sure why he is being listed as a deserter. It sounds like the paperwork got lost during the deployment and since he was not on the ship, they assumed he was gone. He should go to the office where he works and try to get this straightened out. If they do not straighten this out and they try to bring charges against him, contact me and I will try to help get it resolved. If he has been there, he is not a deserter.
