Early Return of Dependents
When a service member leases his/her home during a deployment and then that service member (or his dependents) return before the lease ends, can the service member evict the tenant(s)?
What is the minimum and maximum amount of time that a tenant should receive before his/her eviction?
Which Virginia law governs this decision?

Go see your JAG Legal Assistance Officer ASAP and take a copy of your lease with you. Unless there is a specific clause in your lease covering your situation, the GENERAL rule is that you cannot terminate the lease early except for "good cause" which may be defined in the lease itself or be subject to State law. Remember, a lease is a contract between the landlord and the tenant - if you break the contract improperly, you could be subject to damages. Your legal assistance officer SHOULD be able to handle your question for you, if not, you need to seek a LOCAL attorney who handles real estate and contract matters in your area. Call the Bar Association for a list of name. Good luck!
