Legal Question in Military Law in Virginia

Military fraternization

Is it ok for 2 corporals in the marine corp to have a SEXUAL relationship according to the military laws? Does it have any effect that the man in the relationship is married? Can they get in trouble for that?

Re: Military fraternization

Two corporals are OK under the fraternization rules, so long as one doesn't work for the other one in the chain of command. If one of the corporals is married, and they have a sexual relationship, then that constitutes the crime of adultery under the UCMJ and they can both be in trouble if it's discovered.

Re: Military fraternization

It is not fraternization because you are the same rank unless one of you have a supervisory position over the other. However, it is adultery if you have intercourse since of of you is married. Adultery can be triwed by a court-martial and carries up to one year in the brig. Yes, it is a crime in the military and they can punish you for that.
