Legal Question in Military Law in Virginia

Released after AWOL

If you are an officer and turn yourself in after going AWOL for less than 30 days how long is it until you are released? Will you be held in the briggs/jail until your punishment has been issued?

Re: Released after AWOL

You should not be sent to the brig or stockade at all. The only way you can be confined is if they are sending you to a court-martial and you are deemed to be a flight risk to not appear for the trial. If you turned yourself in, you are not a flight risk and should not be confined. With a short term AWOL, one would normally expect Article 15 punishment whihc cannot include confinement.
