Legal Question in Military Law in Virginia
Served 20 years Navy OTH discharge from an admin board who wouldn't wait for my civil case to be disposed of in civil court. The court case has since been nolle prosqe and now I just wonder if I can get any VA benefits at all. or even have my oth upgraded at least. the characterization was sexual perversion. I was discharged on sep 2008....My Jag told me he didn't think the discharge could be upgraded or that they don't do that often. We submitted a polygraph for the board ( which i passed)but didn't have the effect hoped for. my vote was 2-1 oth discharge. thanks
