Legal Question in Personal Injury in Virginia

1. Is the person or their car insured? In other words, if my mother allows my son to drive her car and there is an accident in her car, does my son's car insurance pay or does my mother's car insurance pay?

2. In Maryland, my sister drives a school bus. In the County school bus lot, my sister was in her bus, behind the wheel, but stopped. She noticed that her own personal car needed to be moved approximately 10 feet. My sister asked her bus aide t please move the car for her. My sister gave her aide her car keys and the aide proceeded to move my sister's car. Unfortunately, the aide ran my sister's car under the school bus, backed up and ran into another bus, then put the car in drive and proceeded to drive my sister's car into a brick wall. The car is totaled, the aide was taken by ambulance and now my sister's insurance has to pay. Why? The aide totaled the car, many witnesses saw what happened, the aide has accepted workman's comp, but my sister is afraid of being sued. The aide will not accept any calls from my sister's insurance company.

I can only answer as to Virginia. Generally speaking, insurance follows the car, as they say. However, the claim would be against the aide and then various insurance coverages may or may not apply. Your sister would be well-advised to have an attorney help. Good luck.
