Accused Faulsely of Bad Check
Due to a casier error while checking out at a nationally known food store chain, the computer stated I had given this store a bad check in the past. The cashier and manager stated this in front of approx. 10 people. After a phone call to the co.'s ''bad check data'' system, it was straightened out and the manager apologized profusely. I was incredibly embarrassed and humiliated. Is this a sueable situation?

Re: Accused Faulsely of Bad Check
You may have a claim for slander, but you should focus on whether the damages justify the expense and effort of litigating. If the store and cashier made a mistake which is easily explained, it may limit your damages. If the store was reckless in its actions, your claim may have more value. I would also focus on how many people heard the comment, and how they reacted. Did you know any of the bystanders? What is your reputation in the community? Also understand the fact the store profusely apologized will likely be communicated to the jury, and could reduce any damage award. I hope this is of some assistance.
