I know assault and battery charges are a misdeamnor, but shooting him, but not killing him a felony?

Yes, under Va. Code Sec. 18.2-26 --attempts to commit
a noncapital felony, such a shooting could be a Class 4, 5, or 6 felony; under 18.2-51.2 might also be charged as an aggravated malicious wounding (Class 2 felony).
Furthermore, the use or display of a firearm in the act described could
result in an independent felony charge under Va. Code Sec. 18.2-53.1.
