Legal Question in Personal Injury in Virginia

A guy I was dating was suicidal and holding a knife to himself, so I tried to prevent it by holding him back. He became infuriated and began to beat me along my back, my neck, and my head. I was also dragged along the street, causing scarring on my legs. Is it too late to press charges? Is there not enough evidence to do so? My mother and his friend saw me hurt the next day but no one saw him beat me. He does have a history of violence, and had hit me before.

If more than 12 months has passed since the incident occurred, it would now be too late to charge misdemeanor assault and battery which has a statute of limitations (SOL) in the Commonwealth of one year.

However, if the facts are such that the matter could be charged as a felony, charges could still be brought since there is no SOL on felonies in Virginia.
