Legal Question in Personal Injury in Virginia

Auto personal injury accident

My son was hit head on by a company van 2 years ago. He is in a wheel chair now with some brain damage but not enough that you can really tell it. He is not incompetent by any means.

The case went to court and he was award a substantial amount of money. It is being appealed now to a state supreme court. The attys are paying all of the bills for him and his wife plus they are giving them money when they need it for buying gifts and eating out.

At Christmas time my son wanted to buy his wife something for Christmas and ask my daughter to pick it up. My daugher called his atty to get the funds and was told that they couldn't give her any money unless they went through my son's wife. My question to you is the money is my son's so why do they have to go through his wife? Seems to me like some games are being played here. The attys also talk to her about the case and very seldom do they talk with my son. I would appreciate any info you can give me.

There is something seriously wrong here; the lawyers should not be paying any living expenses at all. You should contact the Clerk, Iowa Supreme Court, Des Moines, Iowa. The Clerk's number is in the phone book. Ask the Clerk to give you the number of the Ethics Board immediately.

If the case is in fact up on appeal, it's not

clear where the money would be coming from to pay your son's expenses as whoever or whatever entity was found liable in the lower court would not be required to pay until that court's decision

had been afffirmed by the appellate court.

What you have described appears to be a highly anomalous situation that should be investigated by an independent person not connected with the case and who is qualified to undertake such an investigation and can be relied on to give you a fair and honest assessment of the situation.
