Legal Question in Personal Injury in Virginia

Broken tooth

My Question is: Can you sue for breaking two teeth on a piece of cereal? I was eating Cap'tn crunch berries and one of the berries crystalized or something it's hard as a rock! Literally! I still have that piece. If so what is the most you could sue? I am gonna have to get them both pulled and two fake one's to replace!

Thank-you,

Re: Broken tooth

You would have to prove some form of negligence (strict product liability law would not apply here)on the part of the producer and/or distributor of the crunch berries in order to prevail in a civil suit against one or both of these potential defendants.

Under the facts you've described here, i doubt that you could succeed with such a suit and, if you did, your recovery would in all probability be minimal.
