Legal Question in Personal Injury in Virginia

Car Accident

Daughter run off the road by bus driver during school hours.Made contact with dept of transportation and given the run around of not being able to get the statement from the bus driver.after two or three of being told not being able to speak with bus driver or the police officer, got our insurance involved.Our insurance opened the claim, got numerous statements from my daughter.This went on for about two or weeks and we're told they weren't able to speak with anyone regarding the accident.Finally I get an email from our insurance saying basically the claim was passed to the insurance of the school.Their insurance took a statement from my daughter.This accident happened in May and it is August and were are still being told by the school's insurance carrier they are waiting to get a statement from the bus driver.What are rights?I contacted our insurance carrier to ask what is going since I'm told they have a claim open too.No one is contacting me from either my insurance and the school's insurance carrier.What can I do or is there a next course of action for me?I didn't contact our insurance initially because I thought it would be resolved with the school in a timely manner.Many thanks.

unfortunately, this is the way insurance companies work these days--there intention is not to satisfy you, but hold on to their money as long as possible. If your daughters claim is only for the damage to the vehicle, I'd settle the claim with your insurance company, pay the deductible and they will pursue the school to get their money back. Be sure to consider that you are entitled to the cost of repair, the reasonable time you are without your car during repair and depreciation of your vehicle due to the damage. If your daughter was injured, you will need a lawyer.
