Legal Question in Personal Injury in Virginia
My car was recently rear ended as I was at a stop light. The other party has admitted guilt (a teenager txt'ing at the time). I paid 12500 for the car 5 months ago a certified pre owned Toyota corolla. The auto body shop is saying the damage estimate to repair is 7350. Pretty extensive damage report. I have asked for car to be totaled and pay me what the car is worth. The insurance company stae farm is saying no that it is repairable. Do I have to accept this and allow them to repair car?

No, you could sue the driver in general district court for the fair market value of the car at the time of the accident.
