Department Store Building Damage New Car
I bought a brand new Grand
Cheerokee Jeep 7 weeks ago.
Currently, I have 1800 miles on it. I
was parked outside a known
department store and part of the
building collapsed on my vehicle
causing $3500 dollars worth of
damage. I will need a new hood,
bumper, left and right quarter panels
and a new windshield. According to
employees from another department
store next door, the department
store manager was warned last year
that part of the building was failing
down and that someone could be
seriously hurt if not taken care. They
did nothing, which I think is a sign of negligence.
My question is - should I contact a
lawyer to help fight for me a new
vehicle? I think it was negligence on
their part and I don't think I should
pay $40K for a new vehicle that has
only 1800 miles and have it bonded
and spray painted.

No, I don't believe that you're going to get $40K worth of damages(either in the form of a new vehicle or monies paid) from this scenario, but compensatory damages(the $3500) plus consequential damages (the overall diminution of the vehicle's value after the repair arising as a natural consequence of the accident) would seem reasonable.
