Legal Question in Personal Injury in Virginia
discharging an attorney
how do i go about discharging an attorney who has been allegedly working on my personal injury case resulting from a motorcycle vs car accident. the car being at fault. i do not believe he is representing himself as an advocate on my behalf, also seems to not take my injuries seriously until after i have had surgery resulting from the accident. should i mention any untreated injuries it is as though he is not taking me seriously.
also when he said he needed pictures of the cast on my left arm and set up an appointment for me to come in for them, he didn't have film for his camera, so another date was set. again he didn't have film for his camera and set up another appointment. i then went and had the pictures i had taken after the first picture session failed and dropped them off at his office. he also fails to return phone calls when asked. i'm to the point that i'm thinking he is not working for me since i have also have had to do a lot of the legwork myself and tends to neglect giving me pertinent advice concerning what i need to do for this case.
the case has yet to be settled and at one time he told me ''the next offer we will take'' and ''that it would not be in my best interests to fight it ... ''

Re: discharging an attorney
If you've lost confidence in your counsel, you can discharge him by simply writing him a letter discharging him as your attorney with an effective date, detailing the reasons if you like, and requesting, if appropriate, the refund of any retainer fee which has been paid to him but remains unused.
