Legal Question in Personal Injury in Virginia

My dog was loose and ran in front of a van and may have caused damage. I was contacted 4 weeks after the incident saying there was a little under $400 in damage and needed to pay. There is no leash law where I live even though my dog is usually on a leash. I was at the scene afterwards and the driver never showed me damage, but 4 weeks later says there is damage and I need to pay. What are my rights?
