Legal Question in Personal Injury in Virginia

where to file a suit?

I was involved in an accident in county A about two years ago, both parties involved in the accident also live in county A. A suit is filed due to SOL, however, it was filed in an court in an independent city not part of county A. Do you see any problem with it? Does the suit need to be refiled in county A? What about the SOL which is already passed if it is filed today?

Re: where to file a suit?

Normally, the choice of venue for this type of case would be county A where the accident ocurred, however, if the defendants have some connection with the independent city where it was actually filed, such as work or residence, that particular location could also be acceptable.
