Glass in Food

I found glass in my fries. I called the resteraunt and told the manager. He apologized and offered a free meal; I did not accept. Later that day, my tooth starts to hurt. I called back and reported this to the manager on duty. I went to the dentist today who said that he didn't see any damage, but he says that the tooth could still be injured and die later. Under negligence I can get my medical bills paid and 2/3 times this amount in pain and suffering. My visit today was only $73. Can I collect on potential future dental bills? What amount seems reasonable to ask them to file a claim with their insurance company? The resteraunt is a chain with stores in 5 states.

The dentist was probably right. Also, you did not say the glass caused any injury. In my experience, teeth and roots "die" from trauma and blunt force, not foreign objects or slivers of glass. This does not sound like a big case to me and probably won't be in any of the 5 states.

You should've accepted the apology and the free meal, as your claim under these facts is not likely to be considered legally meritorious (in my opinion).
