Legal Question in Personal Injury in Virginia
Hurt on the job
My brother fell works, well worked for a contracted that took down trees. He was up in a tree about two stories when a safety pulley broke, he fell landing feet first and hitting his head. The owner of the company would not allow him to go to the hospital for 3hrs because he wanted to finish the job, then tried to talk him out of going all together because he didnt want a workmans comp claim filed. My brother was seen by a Dr, and returned to work in 2 days time. He told the owner that he needed to return to the Dr due to swelling in his ankle that was injured in the fall and for some back pain he was having..the owner blew up told him he needed to get over it and fired him. There is not a workmans comp claim because the owner decided to pay for the first Dr visit out of pocket. What should my brother do ? He needs further medical care because of the fall but no longer has insurance due to being fired.

Re: Hurt on the job
Your brother should file a workman's compensation claim for his injury.(The fact that his first visit to the doctor was treated as an out of pocket
expense by his former employer should not disqualify his claim if he was in fact injured on the job.)
