Legal Question in Personal Injury in Virginia
Injured at work
Do I have any type of case (financially) for an injury (July 28, 2007) I recieved at work (dislocated and broken elbow)? Workers comp. coved surgery (2 plates, 10 screws), hospital, pay, etc. The accident was my fault (told other guy to turn off machine but didn't give him time to turn it off: wrong place wrong time). However, I was originally told I would be able to straighten my arm back out, now they're saying the way it is, is the way it will be. Also, I still have not regained the feeling in my pinky and ring fingers that extends to the wrist, nor can I close my pinky finger. At times my fingers on that hand will close, sort of like a cramp and most of the time I have to use my other hand to force them back open. My main concern is that if I'm having these problems less than 6 months later what will I experience in 6 years. I can supply more detailed information if needed.

Re: Injured at work
Whatever claim(s)you may have for the injury you received while working would need to be pursued under Virginia workman's compensation law
and not separately as a suit for damages against your employer for negligence or other torts (civil wrongs)which you believe may be connected to the accident which apparently caused your injury.
