Legal Question in Personal Injury in Virginia
I was involved in an auto accident about a week ago. A young woman ran a red light and totaled my truck. There is a $2,000 difference between what the value of the truck the insurance company is paying and the payoff on the truck loan. Do I have a case to?

You could sue the woman for the fair market value of the truck at the time of the accident but if it (your damages) amounted to about what her insurance company is willing to pay you, it would make little sense to litigate the matter. (The fair market value of a vehicle is often substantially less than what the victim may still owe on the vehicle loan.)
