Legal Question in Personal Injury in Virginia
I was involved in a hit and run accident when a person turned R in the outside turn lane across 4 lanes of traffic and hit me in my rear passenger door. I reported this immediately at the time of the accident. The man was located a week later and is being charged with hit and run(initial court date in July 2011). Four days after the accident and after he was contacted by his insurance company regarding the accident he went to a police station and reported that I hit him and then left the scene of the accident. I have significant damage to my car. The other driver contests my version of the events and has told his insurance company that I ran a red light. The insurance company has as a result denied the claim. The police report supports my description of the accident although there are no independent witnesses to verify who had the red light.. Can I take him to civil court?
