Legal Question in Personal Injury in Virginia

Lawyer Wants to Quit

I have a Personal Injury lawyer that has been working of my case for 3yr. I told him at the beginning that I did not want to settle my case I wanted to take it to court, so he accepted my case and filed it in court. Now after 3yr he wants to quit because I want settle the case. He says he has two children and it is just he and his assistant working and they can't pay for the deposition. Can he just drop my case or is their something that I can do legally about this?

Re: Lawyer Wants to Quit

If suit has been filed, then the lawyer must get court permission to withdraw from your case. You can object to the withdrawal, but unless it is close to a trial date, or there are other factors which would significantly prejudice your case if he withdrew, the court will probably allow him to withdraw. You could write a letter to the judge to whom the case is assigned letting him or her know just what your feelings are in regard to this matter.
