Legal Question in Personal Injury in Virginia

Liability for slip/fall injury on ice in front of a store after snow/ice storm

While walking from paking lot to work, I slipped and fell on ice in front of store that was not open at the time. Most busineeses in block had cleared away ice except for this shop. I was not visiting the shop and it was not open at time of accident. But I had to walk in past this store to get to my destination. Also, I had no other path but the side walk which was covered with ice. My question, does the city or the shop owner have any liability for my injury?

Re: Liability for slip/fall injury on ice in front of a store after snow/ice sto

It depends, among other factors, on (1) whether you could be considered to be contributorily negligent or to have assumed the risk of such injury; (2) whether at that point the duty to have the snow cleared had come into play - there is no duty while precipitation is still falling and for a reasonable time thereafter; and (3) who had the duty to clear the snow/ice. You should consult with a lawyer practicing personal injury law to go over these facts and see if you may have a claim.
