Very good question(s), which are why you need to secure the assistance of an attorney who is knowledgeable and can advise you in these matters.

There is no such automatic rule. You need to identify all of the possible damages you can claim. This does require the assistance of an attorney. Most people don't know about or forget about 1/2 to 2/3rds of the possible damages that you might claim. You MIGHT be able to sue for pain and suffering, but only the jury can decide how much to award for pain and suffering. When settling out of court, people may guess, which may be what you've heard. It is very hard to get punitive damages in Virginia, and that depends on the circumstances.
