Legal Question in Personal Injury in Virginia

Maryland Accident Virginia Insurance Company

I was a passenger in a car accident in Maryland. However the driver of the car I was in was from Virginia and hence the place where the car is registered and insured. The other car involved in the accident was from Maryland. The Maryland car is willing to settle for my personal suffering, but will not pay my bill for the ambulance ride. The Maryland Company says that the other insurance company should pay that. The other insurance company will not pay that saying that because the accident did not happen in Virginia I as a passenger would not be covered for the accident that occurred in Maryland and they would not pay the bill for the ambulance ride. Is there anything I can do to have someone pay this bill for me or do I have to take the money out of my personal suffering settlement to pay for the bill?

Re: Maryland Accident Virginia Insurance Company

If the MD registered vehicle was at fault, that policy is liable to pay any losses you sustain, whether they are medical bills, earnings loss, pain and suffering or anything else. Once you have recovered from your injuries, an experienced personal injury attorney would be able to assist you in putting a settlement package together that would maximize the recovery you would obtain.

If the vehicle you were occupying had a type of coverage known as medical payments, that coverage would pay for your medical bills as they are incurred. This coverage is payable regardless of fault. I have never heard of a policy that only pays benefits if the accident occurs in the state where the policy was issued, and I've been practicing in this area for 27 years. The nice thing about this is that you don't have to repay the VA insurer from any settlement you obtain from the MD policy.

You would be well advised to retain an attorney to assist you in this matter; otherwise both insurance companies will take advantage of your naivete and you won't get what you're entitled to. If I can be of any further assistance, please let me know.
