Legal Question in Personal Injury in Virginia

Medical Information to the Insurance Company

I was rear-ended and both the at-fault driver's and my auto insurance are taking care of the medical bills. They both want medical release for records 5 years prior through the end of my treatment. Bills for accident are so far around $1,000. I had muscle spasms, meds and starting physical theraphy. Can I give both insurance companys copies of the bills? If so, what types of paperwork do I need to get from the doctors to satisfy the insurance to pay the claim? Can the ins companys demand I sign the release?

Re: Medical Information to the Insurance Company

You need to provide the insurance carriers with copies of your doctor's statement setting forth a diagnosis of the injuries which you allegedly received in this particular accident along with a description of the treatment regimen which has been undertaken to address whatever injuries you received from this accident.

You could certainly provide copies of the medical bills to the insurance carriers but signing the release would be simpler in the interest of expediting matters unless you have certain medical information which you prefer

to keep strictly confidential.
